As a service to the community, The Probate Pro is committed to providing up-to-date and accurate information about the many probate courts in which it appears. The Wayne County Probate Court continues to update its hours of operation as a result of COVID-19.
Until further notice, the Wayne County Probate Court is not physically accessible to the public. And most importantly, no in-person filings are permitted. Until further notice, all hearings are being conducted remotely through the application called ZOOM. The Wayne County Probate Court instituted these extraordinary measures to protect the public and staff, in compliance with Governor Whitmer’s executive orders.

Monday – Friday
8:00am to 12:30pm and 1:30pm to 4:30pm
The Court is closed between 12:30pm and 1:30pm.

During the COVID-19 restrictions regarding the inability to file in person probate pleadings, the Court has established a process for filings by email, fax or US Mail. Michigan’s State Court Administrator’s Office is assisting courts around the state to prioritize filings based on the urgency of the situation. So, if your filing is an emergency, it is important to include in your filing details whether the filing is an emergency or must be expedited. Specifically, the probate court requests that you include “emergency” in the subject line or fax cover sheet with a brief description of the emergency.

The Probate Court created a chart that assists in where and how to file probate pleadings. The chart can be found here. The chart helps identify for each type of probate proceeding where the document should be filed.
Probate pleadings to initiate a probate estate and filings for the probate counter clerk can be faxed to (313) 967-4030 or emailed to firstname.lastname@example.org. For probate pleadings that need to be filed with a particular probate court judge, use the following table.

The following are some specific examples of pleadings that are considered priority filings under Michigan law. These filings should take precedence over other probate filings at the court.
- Proceedings regarding involuntary mental health treatment.
- Pick-up / transportation orders pursuant to MCL 330.1436 and 330.1426;
- Petitions for initial or continuing involuntary hospitalization pursuant to MCL 330.1472a.
- Petitions for immediate funeral and/or burial arrangements pursuant to MCL 700.3206 and 700.3614.
- Emergency petitions filed by the Adult Protective Services (APS) under MCL 400.11b(6).
- Emergency Petitions for Guardianship pursuant to MCL 700.5312
- where there is a life-threatening circumstance or the person needs emergency medical care that is not being provided without a Guardian.
- Emergency Conservatorships and other protective orders pursuant to MCL 700.5407
- where there are immediate pending evictions/foreclosures/shut off notices.
- Estates where immediate access to residence is necessary under MCL 700.3614.
- Ex-Parte requests for temporary restraining orders.
