The State Court Administrative Office (SCAO) is the administrative agency of the Michigan Supreme Court. The Supreme Court has administrative oversight of Michigan’s courts and exercises that oversight through the SCAO. It is responsible for developing, maintaining, and providing standardized court forms for use in Michigan’s trial courts. These forms are used by court clerks, judges, attorneys, and litigants to facilitate court proceedings and ensure consistency and efficiency in the court system.
It produces probate forms for filing with the probate court. These forms periodically get amended. Many of those probate forms will be replaced and updated by SCAO as of April 9, 2023.
Probate Forms Updated by SCAO
There are many different SCAO (State Court Administrative Office) forms that are used in probate proceedings in Michigan. Some of the most commonly used probate forms include:
- Petition for Probate and/or Appointment of Personal Representative (PC 558): This form is used to request that a probate court admit a will to probate and appoint a personal representative to administer the estate.
- Acceptance of Appointment (PC 559): This form is used by a person who has been appointed as a personal representative to accept their appointment and acknowledge their responsibilities.
- Inventory (PC 571): This form is used to list all of the assets of the estate and their estimated value.
- Notice to Creditors (PC 575): This form is used to provide notice to creditors of the decedent’s death and to give them an opportunity to file a claim against the estate.
- Petition for Conservatorship (PC 625): This form is used to request that a probate court appoint a conservator to manage the affairs of a protected individual who is unable to do so themselves.
- Petition for Appointment of Guardian for an Alleged Incapacitated Individual (PC 647): This form is used to request that a probate court appoint a guardian to make decisions on behalf of an individual who is alleged to be incapacitated.
These are just a few examples of the many different SCAO forms that are used in probate proceedings in Michigan. The specific forms used will depend on the circumstances of each individual case.
